True, that was its mandate from the governor. But Mr. Mead made a huge mistake there. Since the report provides no sense of direction, the governor has forced someone else to assume that role. That is the vacuum which is pulling Mr. Lubnau and possibly the Rules Committee into the fray.We urge lawmakers to take a different path.Leadership must sit down with the governor to try to find a way to appoint an independent counsel to lead this investigation.No one we have talked to in state government seems to know how to make that happen. Both lawmakers and the governor are treading new ground, after all.Does Mr. Mead have the authority to appoint a counsel? Can lawmakers pass a statute? Is there an independent body, like the State Bar Association, that would be better suited to make the appointment? Regardless of who finally acts, it must be as politics-free as possible.This independent counsel already will have the McPherson report and attending documents, so the timeline for his or her investigation will be shortened significantly. Still, this counsel must be given the legal powers, such as the ability to issue subpoenas, to go wherever the investigation leads. The goal must be to issue a list of charges, if any, that lawmakers can take to impeachment proceedings should they go in that direction.Again, we would prefer that they slow down and let the information develop. But if they can t or won t then legislative leadership must separate itself from the investigative process.Appointing an independent counsel would allow them to do just that.
